Hi! Thank you so much for reading our Terms. They may be a bit dry (unlike our tours) but they are important, so we hope you read the whole thing. You are now part of the teletour family and, like all families, we have family’s rules, so we can all get along while we are hanging out together.
Always trying to improve our Terms:
Transparency is one of our values. That means we try hard to tell you everything you need to know while keeping it concise so you can actually read it all. If you ever think we have that balance wrong and these Terms don’t give you the information you need, please email us at [email protected] and we will try hard to be better.
Please also know that we are constantly looking to improve teletour and that means we will probably be regularly updating our Terms. Any changes will only apply going forward and we will work to tell you about changes quickly when they are made.
What is teletour:
Teletour is an application that teleports our users (we call you our “Global Citizens”) through our application to sites around the world in an instant in order to enrich and educate you and, in the process, working hard to do good. We do this by allowing our approved teletour tour guides to provide immersive recorded, live and 360 degree tours and by providing our Global Citizens a platform to give back to the communities that have touched them and to support the tour guides that provide them this rich travel experience. We are actively working on how best to give back to the communities we visit so if you have an idea, please email us at [email protected].
When we talk about teletour in these Terms we are referring to our application and website and the products, services and features we make available to you as part of the application and website.
As a company, we are Be There Do Good, Inc, a Delaware company, located in Vienna, Virginia. We own teletour. If you ever want to contact us for any reason, please email us at [email protected].
We believe in doing the right thing. For us, that means treating other people and other people’s property the same way we want ourselves and our property to be treated. We believe in being inclusive and treating everyone the same regardless of their race, sexual orientation, or beliefs. We believe in abiding by the law. As we said above, we also believe in transparency, so we want you to know what rights and obligations each Global Citizen has when using teletour and what legal protections our lawyers have convinced us we need to have. These Terms are meant to guide all of us along this path.
The Terms:
These Terms make up an Agreement between you and us and, if you choose to use teletour, you have to follow these Terms, and any other policies and guidelines we set-up, at all times.
Please make sure you understand these Terms. By using teletour you are agreeing to all of the Terms. If you don’t agree to the Terms, or you don’t agree to any provision, you may not use teletour. If that is the case, please also let us know at [email protected] so we can understand your points and consider addressing your concerns on the next version of these Terms.
You do need to be at least 13 years old to use teletour. If you are under 18 years old you will need your parent or guardian to read these Terms and give you permission to use teletour. If you are between 13 and 18, please get their permission because they will be responsible for how you use teletour, so it is only fair to loop them in.
If you are with a company or organization and you are using teletour on their behalf, by using teletour you are representing to us that you have authority to act for that company or organization and that it accepts these Terms.
Tours:
When we say Tour Content in these Terms, we mean all of the teletour content including audio, video, design, graphics, pictures, text, brands, tradenames, trademarks, features, advertisements, software, analytics and everything else provided for you by us, our teletour tour guides, our Global Citizens and any other people or organizations using teletour.
You are responsible for any Tour Content you provide, including any comments you make on teletour. While we hope to be a place where Tour Content is shared enthusiastically, teletour is under no obligation to host or display Tour Content we decide, for any reason, should not be on teletour. If you see any Tour Content (including tours, profile information, comments or any other Global Citizen contributions) that you believe does not comply with these Terms, or that violates the law, please let us know immediately at: [email protected].
Your Personal Information:
Our Privacy Policy explains how we treat your personal data and how we will protect your privacy when you use teletour. If at any time you would like us to delete your personal information from teletour and our systems, please notify us at [email protected].
If you learn of any unauthorized use of your password or teletour account please contact us at [email protected].
Use of teletour:
As long as you continue to comply with these Terms, our policies and guidelines, and applicable law, and for so long as you only use teletour for personal, non-commercial use, we will continue to allow you to use teletour. By non-commercial use, we mean that you need our prior written permission to publicly screen any Tour Content or stream any music from teletour.
Please know that you are not allowed to access, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify or otherwise use any part of teletour or any Tour Content except as we specifically state in these Terms or with our prior written permission.
Here are a few other things that I don’t think you ever intend to do but our lawyers say we have to tell you clearly:

Commit fraud in connection with your use of teletour;

Copy, change, extract code, reverse engineer, lease or sell any portion of the teletour software or try to interfere or disable teletour;

Copy Tour Content that is not yeours;

Gather personal information about our Global Citizens;

Use teletour through bots or other artificial means;

Manipulate directly or indirectly teletour tour guide statistics (such as a tour rating, the number of followers of a teletour tour guide, or the number of travelers viewing a tour);

File or pursue groundless, intentionally aggravating or frivolous complaints or disputes relating to teletour or Tour Content; or
-
Run contests on teletour, unless approved in advance by us.
Unless permitted by these Terms or approved in advance by us in writing, we also do not permit you to include any advertising or promotions around any Tour Content that you place on teletour, to use teletour to solicit Global Citizens or other people, or to run contest.
Our Service:
While we are eager for you to use teletour, you should know that your use does not give you ownership of or rights to any aspect of teletour, including user names or any other Tour Content posted by others or teletour. However, if you become a teletour tour guide you will always own the tours you put on teletour and, as described below, you always have the right to remove those tours from teletour.
Becoming a teletour Tour Guide:
If you are creative and want to share the story of the place where you live, have lived, or love, please visit teletour.tv to seek approval to become a teletour tour guide. While teletour is full of experienced tour guides, we are seeking all types and styles of travel storytelling and we are always looking for new teletour tour guides. We love uniqueness.
As an approve teletour tour guide, you will have access to additional features and functions, such as the ability to upload tours and receive certain benefits from the tours you upload. One such benefit is to receive tips through teletour. teletour tour guides receive 70% percent of the net tips received by teletour (after deduction of payment processor fees, such as Apple, Google and/or Stripe fees) made by Global Citizens for your tours. We retain 30% of the net tips to cover our costs to manage teletour, which includes managing the tipping process and the payment of tips to the teletour tour guides. It is more time consuming than you realize, or we originally expected.
As a teletour Tour Guide:
If you are an approved teletour tour guide, you may be able to upload Tour Content indirectly or directly to teletour, perform a live tour viewable by teletour Global Citizens (which we may then use to create an exact or revised copy to remain as Tour Content onteletour), provide commentary of a recorded tour on teletour, and other related activities. While the primary purpose of all tours is to provide an immersive experience of a local environment to Global Citizens, you may, subject to guidelines established or modified by teletour now or in the future, promote your business in subtle ways within your Tour Content and within your profile. If you choose to upload Tour Content, you are responsible for such Tour Content. You must not include anything in your Tour Content that does not comply with these Terms, any teletour policies or guidelines, or the law; or that includes third-party intellectual property (such as trademarks, copyrights or branding) unless you are permitted to do so. Regarding applicable laws and regulations, you, of course, must comply with all of them, including those relating to entering other people’s property, and getting any required permission to film other people or their property. We may review your Tour Content at any time and remove such content if we believe the above Terms have not been followed.
You Own Your Tours:
You retain ownership rights in the tours you upload on teletour and you may have those tours removed from teletour at any time by emailing us at [email protected]. When you terminate your account with teletour, we will also delete all your profile from teletour We own any other Tour Content that is posted on teletour (such as travel information and comments).
While you have a tour and profile on teletour, you do grant to teletour a worldwide, royalty-free, non-exclusive, sublicensable and transferable license to use such tour and profile in connection with teletour and our business, including for the purpose of promoting teletour. You specifically agree that teletour may use portions of your tours (both video clips, audio clips and still shots from your tours) in our social media, online, web, televised, radio and hardcopy advertising. If you are ever concerned with how we have used or referenced your tours in our advertising, please let us know and we will work to address such concerns in our future advertising.
You also grant each other Global Citizen a worldwide, royalty-free and non-exclusive license to access your tour and profile through teletour, and to use that tour and profile as permitted by these Terms. No Global Citizen may make use of your Tour Content outside of teletour.
Removing Your Tour Content:
To remove your Tour Content from teletour, please contact us at [email protected].
If your Tour Content violates the intellectual property rights (including trademarks, copyrights, or branding) of anyone else, you must immediately request the removal of such Tour Content from teletour.
Removal of Tour Content by teletour:
We may remove your Tour Content from teletour at any time for any or no reason. In particular, we may take down your Tour Content if we reasonably believe that such content is in breach of these Terms or may cause harm to teletour, one or more of our Global Citizens, or any third party. You can report any such concerns to us about any Tour Content at [email protected].
If one of your tours or profile is removed from teletour, the license you grant will cease after we are given a reasonable amount of time to properly delete your tour or profile. However, teletour may retain copies of your removed tour and/or profile so long as we do not publicly display them.
Trademark and Copyright Protection:
If you believe Tour Content, or any aspect of teletour infringes your trademark or copyright, please contact us at [email protected].
Termination of Your Usage or Suspension:
We hope we will not have to do this but teletour may suspend or terminate your access to all or part of teletour if you violate these Terms, if you intentionally or repeatedly violate another’s intellectual property (including trademarks, copyrights and branding), if we are required by law or court order, if your conduct could hurt or create liability to any Global Citizen, or if your use of teletour is unusual and causes us financial loss.
About Software in the Service:
We are always seeking to improve teletour. That means we will always be making changes to teletour. As a result, as part of these Terms, you give us permission to update the software of your device automatically when we have a teletour software update. teletour gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the teletour software, unless we notify you of a necessary separate license. Some teletour software may be open source and subject to a related license with terms that may override these. Our license to you is solely to allow you to use teletour as permitted by these Terms.
Special Bonus Material from our Lawyers:
All of the provisions of this section of the Terms shall survive termination of our agreement of these Terms.
Our lawyers say that the following provisions need to be in all CAPS….ugh.
WE DO NOT WARRANT OR MAKE ANY SPECIFIC COMMITMENTS ABOUT TELETOUR, INCLUDING THE FACT THAT WE DO NOT WARRANT (I) THE TOUR CONTENT, (II) THAT ANYONE WILL HAVE ACCESS TO YOUR TOUR CONTENT, OR (III) THAT THE TOUR CONTENT IS ACCURATE, RELIABLE, AVAILABLE OR MEETS YOUR NEEDS. TELETOUR IS PROVIDED “AS-IS’.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND REGARDLESS OF WHETHER A CLAIM IS BASED ON TORT, CONTRACT, WARRANTY OR ANOTHER LEGAL CATEGORY OF CLAIM, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES WILL NOT BE RESPONSIBLE FOR ANY (I) INDIRECT, CONSEQUENTIONAL OR PUNITIVE DAMAGES; (II) LOSS OF REVENUES, PROFITS, REDUCTIONS OF COSTS, BUSINESS OPPORTUNITIES, OR REPUTATION; (III) DATA LOSS OR CORRUPTION THAT IS CAUSED TELETOUR SERVICE OR SERVICE CHANGES; (IV) DELETION OF OR INACCESSIBILITY TO THE TOUR CONTENT; (V) SOFTWARE VIRUSES THAT ARE TRANSMITTED BY ANY THIRD PARTY INTO OR THROUGH TELETOUR; (VI) ANY TOUR CONTENT (THROUGH YOUR USE OF SUCH TOUR CONTENT OR OTHERWISE) REGARDLESS OF WHETHER THE TOUR CONTENT IS PROVIDED BY TELETOUR OR NOT; (VII) UNAUTHORIZED USE OF OR ACCESS TO TELETOUR; (VIII) PERSONAL INJURY OR DAMAGE TO PROPERTY FROM OR DURING USE OF TELETOUR; AND/OR (VIII) ANY TELETOUR OR TOUR CONTENT ERRORS OR INACCURACIES.
FOR ANY CLAIM RELATING TO OR ARISING FROM TELETOUR, WE AND OUR AFFILIATES’ MAXIMUM LIABILITY FOR SUCH CLAIMS IS THE GREATER OF: (A) $600, OR (B) REVENUES RELATING TO TELETOUR THAT YOU EARNED AND RECEIVED FROM US OVER THE TWELVE (12) MONTHS PRIOR TO OUR RECEIVING NOTICE OF YOUR CLAIM.
To the extent permitted by applicable law, you agree to defend, indemnify and hold us harmless and our affiliates, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to teletour; (ii) your violation of any of these Terms; (iii) your violation of any third party rights, including without limitation any intellectual, property, or privacy right; or (iv) any claims of damage to a third party caused by your Tour Content.
teletour has no control over, does not own, and assumes no responsibility for, any websites and online services for which there is a link within teletour.
These Terms and any claims relating to them or teletour will be governed by the law of the State of Delaware, except for Delaware’s conflict of laws rules, and any litigation relating to these Terms will be handled exclusively in the United States of America in the federal or state courts of Wilmington, Delaware. You and we consent to personal jurisdiction in these courts. Any cause of action relating to or arising out of teletour must begin within twelve (12) month after the cause of action supporting the relevant claim occurs or such claim is barred permanently.
Examples in these Terms are just one possible example of what the relevant provision of these Terms seeks to address.
When used in this Agreement, “include” and variations of it, it means “including but not limited to,”.
We reserve the right to take action to address your failure to comply with these Terms at any time, even if we did not take immediate action upon learning of your failure to comply.
If any provision of these Terms is not enforceable for any reason, all other provisions of these Terms shall remain enforceable.
